Warranty Obligations
The goods delivered to the Buyer are covered by the warranty obligations of the Seller or the manufacturer. The warranty period is specified in the product passport. The product passport, in the part that contains information on warranty obligations, as well as installation and operation conditions, is an integral part of the supply contract.
Warranty obligations are valid only if the Buyer (or other user) complies with the rules of transportation, operation, installation, dismantling, connection, and commissioning of the product, as well as the standards and conditions for proper use as recommended by the manufacturer and/or Seller and specified in the product passport and/or operating manual.
The loss or absence of the passport is not a valid reason for non-compliance with installation and operation requirements stated in the product passport. Additionally, in case of passport loss or absence, the Seller reserves the right to void the warranty.
The warranty period begins on the day of product sale. The date of sale is considered the date of signing the delivery note and/or issuance of other accompanying documents confirming the actual shipment of the product.
If the product malfunctions or other defects occur within the warranty period, the Buyer must notify the Seller within 7 (seven) business days from the moment the defect is discovered.
If the defect is recognized by both parties as a warranty case, the Buyer has the right to request the Seller or manufacturer to perform warranty repair or replacement of the product.
The determination of whether the issue is a warranty case, as well as the procedure for refunding payments to individuals, is further regulated by the Law of Ukraine “On Consumer Rights Protection.”
Defects caused by normal (natural) wear and tear of the product are not considered warranty cases.
Warranty does not cover components that were independently put into operation by the Buyer.
Warranty repairs are carried out at the service station of the Seller or manufacturer. All transportation costs related to the delivery of parts and assemblies are borne by the Buyer.
If necessary, by mutual agreement of the Parties, an independent expert organization may be involved to determine the cause of the malfunction.
The Buyer has the right to demand a warranty replacement only in case of a significant defect in the product.
Warranty does not apply in the following cases:
- The malfunction occurred due to incorrect use of other components related to the product’s intended function;
- The product was used for purposes other than intended;
- The product was operated in violation of the manufacturer’s or Seller’s instructions;
- The product has damaged seals or signs of tampering or disassembly;
- The product is damaged or has been physically modified;
- The product shows performance deviations caused by improper installation or operation.
Definitions
Warranty case – failure of the product during the warranty period due to reasons beyond the control of either party, caused by: 1) manufacturing defect (due to violation of production technology); 2) use of poor-quality materials by the manufacturer.
Warranty replacement – replacement of a product with significant defects, identified during the warranty period, with an equivalent or similar product of proper quality by the party responsible for warranty obligations.
Warranty repair – actions aimed at restoring the working condition and functionality of the product, carried out by the party responsible for warranty service in case of a warranty case.
Warranty period – the period during which the Seller and manufacturer guarantee the quality of the product.
Payment date – the date on which the Buyer’s payment is credited to the Seller’s account, either partially or in full.
Significant defect – a defect caused by the Seller or manufacturer, due to which the product cannot be used as intended, and which reappears after repair due to reasons beyond the Buyer’s control, and meets at least one of the following criteria: a) it cannot be eliminated at all; b) it requires more than thirty calendar days to eliminate.
Returns and Exchanges
According to the Law of Ukraine “On Consumer Rights Protection,” the Buyer has the right to return or exchange a purchased product within 14 days of purchase.
Returns and exchanges are accepted only if the Buyer presents a receipt and the product has not been used, retains its commercial appearance and completeness, and includes all labels, stickers, factory markings, manuals, and undamaged packaging.
